1. Agreement to Terms
By accessing or using the Learning Management System (“LMS,” “Site,” or “Service”) operated by ATII (“we,” “us,” or “our”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you must not access or use the Site.
If you are accessing the Site on behalf of an educational institution, organization, or employer, you represent that you have the authority to bind that entity to these Terms, and “you” refers to both you individually and that entity.
2. Eligibility and Account Registration
2.1 Eligibility. You must be at least [13/16/18] years of age to create an account. By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content solely for the purpose of operating and providing the Service. You represent that you own or have the necessary rights to any User Content you submit and that it does not infringe any third party’s rights.

5. Acceptable Use and User Conduct
5.1 General Conduct. You agree to use the Site in a respectful, responsible, and lawful manner. You must not :

Post or transmit any content that is obscene, offensive, discriminatory, or hateful

5.2 Academic Integrity. You agree to uphold the highest standards of academic honesty. The following are strictly prohibited :
Cheating: Using unauthorized materials or assistance during assessments
Plagiarism: Representing another’s words, ideas, or work as your own, including content generated by artificial intelligence
Collusion: Unauthorized collaboration with others on individual assignments
Impersonation: Having another person complete coursework or assessments on your behalf
Violations of academic integrity may result in disciplinary action, including course failure, account suspension, or permanent termination.
5.3 Consequences of Violation. We reserve the right to determine, in our sole discretion, the appropriate response to any violation of this Section, which may include a warning, removal of content, suspension of access, or termination of your account.
6. Payment Terms
6.1 Fees. Certain courses or features may require payment of fees. All fees are stated in US dollars and are exclusive of applicable taxes unless otherwise noted. You agree to pay all fees associated with your account.
6.2 Payment Methods. We accept payment through third-party payment processors. By providing payment information, you authorize us and our processors to charge the applicable fees. You represent that you are authorized to use the payment method provided.
6.3 Refunds. All purchases are final and non-refundable, except where required by applicable law. If you believe you are entitled to a refund, please contact us at info@africtechi2.com within [2] days of purchase.
6.4 Subscription Terms. If you purchase a subscription, it will automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel your subscription through your account settings. Cancellation will take effect at the end of the current billing period.
6.5 Price Changes. We reserve the right to change our fees at any time. We will provide reasonable notice of any price changes before they take effect.
7. Privacy and Data Protection

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
8.2 Educational Outcomes. We make no guarantees regarding your academic performance, test results, certification outcomes, or any other educational or professional results. Your success depends on your own effort and other factors beyond our control.
8.3 Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Your violation of these Terms
Your violation of any third-party rights, including intellectual property rights
Any User Content you submit to the Site
10. Termination
We may terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Site will cease immediately. Sections 4, 5, 7, 8, 9, 11, and 12 shall survive termination.
11. Governing Law and Dispute Resolution
11.1 Governing Law. These Terms shall be governed by and construed in accordance with the laws of California, USA, without regard to its conflict of law provisions.
